GENERAL CONDITIONS & RENTAL AGREEMENT

 

 

RESERVATION:

For promotional offers and reservations of up to 7 nights, as well as those made within 60 days of the arrival date, the guest must pay the full cost of the rental at the time of booking. For stays of more than 7 nights, you will have 2 days (48 hours) to pay a deposit. The reservation is confirmed upon receipt by LA CASANITA Ltd of a 50% deposit.

BALANCE PAYMENT:

The balance of payment must be paid at least 60 days prior to your arrival. If the balance is not received by LA CASANITA by the due date, LA CASANITA reserves the right to cancel the reservation, without prejudice to its right to charge cancellation fees, and to retain the deposit.

Special case: Christmas/New Year's Day between December 15th and January 10th of the following year, the balance must be paid 60 days prior to the arrival date.

PAYMENTS:

Payment is by *bank transfer* (*Bank fees at your expense)

Upon receipt of your payment, we will email you a printable confirmation/invoice for your reservation. This confirmation will serve as your rental agreement and will be useful when clearing customs.

CONDITIONS OF STAY:

Occupancy of the villa or apartment is strictly limited to the number of people specified at the time of booking and corresponding to the price of the reservation. It is strictly forbidden to sublet or accommodate additional people without the written consent of La Casanita Ltd.

 

The villa rental contract and overall billing will be in a single name, with the full names of the other tenants listed. Security deposit: A security deposit will be required; it will be returned after an inventory has been completed on the tenants' departure date. Stay and Liability

Check-in Check-out

The villa or apartment will be available from 2:00 PM on the day of arrival and must be vacated by 11:00 AM on the day of departure. However, if the villa or apartment is available before 2:00 PM on the day of arrival, LA CASANITA LTD will do its best to ensure the guest can check in immediately.

The villas' capacity is limited and is stated in our rates and the booking form (including children). If we observe that the number of guests exceeded, or if the tenants' actions violate local laws, if the guest breaks items, or violates basic standards of etiquette, we reserve the right to ask the tenants to vacate the premises immediately, without notice, and without refunding the remaining rental days. The guest is required to treat the villa and its amenities with the utmost care and consideration. If any damage occurs during their stay, the guest must immediately notify the owner or our local agent and reimburse the damage or replace the items. The tenant (the person who accepted the reservation) is also responsible for their fellow guests and children. If the guest decides to vacate the premises of their own free will, cancels their reservation, or shortens their stay, no refund will be issued.

 

LIMITATION OF LIABILITY:

LA CASANITA Ltd shall not be held liable for the following problems: Water supply (drought, water cuts due to government regulations) and/or electrical supply (power outages), as well as noise pollution. Similarly, any unforeseeable natural event, such as bad weather, cyclones, tides, strong winds, etc., that may alter all or part of the services offered, either by making it impossible for LA CASANITA Ltd to fulfill the terms of the reservation or by causing a discrepancy between the reservation form and the actual situation at the time, shall not incur any direct or indirect liability on the part of LA CASANITA Ltd, and no financial or other compensation may be claimed. However, in the event of a force majeure event, LA CASANITA Ltd will endeavor, wherever possible, to offer a commercial solution to satisfy the customer. Villas with pools are strictly reserved for adults and children who can swim under parental supervision. Access to pools is generally not secured, and guests are responsible for taking all necessary precautions. LA CASANITA Ltd declines all liability in the event of an accident. The rental descriptions in brochures and websites are valid as of the date of publication.

Extension of Stay

The duration of the stay may be extended on site, subject to availability. If the guest wishes to extend their stay, they must complete all necessary procedures with the airline of their choice and contact LA CASANITA Ltd as soon as possible to determine the terms and conditions of the extension.

CUSTOMER CANCELLATION AND MODIFICATION FEES

In the event of cancellation by the customer, "the deposit, insurance and bank fees are not refunded."

Except in cases of force majeure:

Death or illness preventing the person from traveling (we will require a certificate). Any cancellation or reduction in the length of stay by the guest must be confirmed by registered letter before the scheduled departure date. Upon receipt of the deposit by LACASANITA LTD, the reservation is firm and final. In the event of cancellation or reduction in the number of nights, the guest agrees to pay the balance of the invoice, up to the following cancellation penalties:

 

• Between 90 and 74 days before the start of the stay: 20% of the total invoice.

• Between 75 and 45 days before the start of the stay: 50% of the total invoice.

• Between 44 and 30 days before the start of the stay: 75% of the total invoice.

• Between 29 and 1 day before the start of the stay: 100% of the total invoice.

We strongly recommend purchasing travel insurance to cover cancellation costs.

CHANGES OR CANCELLATIONS BY LA CASANITA Ltd: Force Majeure** (**Exceptional, unforeseeable, and irresistible event justifying release from an obligation, commitment, or liability). Fire, water damage, death, sale, repossession of the property by the owner, etc.

Although it is unlikely that LA CASANITA Ltd will need to make any changes to confirmed agreements, this may unfortunately happen for reasons beyond its control.

LA CASANITA Ltd will not be in breach of this Agreement if it fails to provide the services contemplated by this Agreement, and will be entitled to cancel a booking if it is no longer able to provide accommodation, as a result of one or more of the following circumstances:

 

1 - Part of the residence is closed due to fire, alterations, or renovations,

2 - The supply of gas, electricity, or water cannot be guaranteed for reasons beyond the control of LA CASANITA Ltd.

3 - The residence is unable to honor the reservation due to a staff strike,

4 - An event such as fire, lightning, explosion, riot or civil war, malicious acts, storms, cyclones, burst pipes, earthquakes, tsunamis, etc., may result in your accommodation being unable to offer the reserved services,

5 - The residence or any part of it is reserved for another use.

GUEST REACCOMMODATION

In the event that a property booked by the guest is unavailable, LA CASANITA Ltd reserves the right to relocate the guest to another LA CASANITA Ltd property of an equivalent standard, without the guest being entitled to any compensation. If the guest is not satisfied with the alternative accommodation offered, LA CASANITA Ltd will refund the amounts paid by the guest, without the guest being entitled to any compensation.

ACCOMMODATION RECEIPTIn the event that the guest is not satisfied with the reserved villa, they must notify LA CASANITA upon arrival, prior to the keys being handed over. Subject to the validity of the reasons for dissatisfaction, LA CASANITA will make every effort to offer, subject to availability at that date, a replacement villa of a price and standard equivalent to those stated at the time of booking. The guest's acceptance of the replacement villa constitutes a waiver of any right to claim. If the reasons are unjustified, no refund will be made.

 

Air Transportation

Flight delays or cancellations due to airlines will not result in any compensation, refund, or extension of the rental period.

 

External Activities

Sporting and non-sporting activities, visits, excursions, and boat trips undertaken during the stay are at the guests' own risk, as is the rental of motorized or non-motorized equipment. LA CASANITA Ltd. cannot be held liable for services provided by a third party, even if recommended by LA CASANITA Ltd. or one of its representatives

Activities offered by LA CASANITA Ltd

The visits, excursions, transport, sea trips, sports or other activities offered by LA CASANITA Ltd are organized under the full responsibility of the subcontractors of LA CASANITA Ltd. LA CASANITA Ltd can in no case be held responsible for any accident occurring during a visit, sea trip or practice of one of these activities whatever it may be and no physical, moral or financial compensation can be claimed from it. Although LA CASANITA Ltd strives to achieve constant quality in the selection of its subcontractors, all complaints regarding quality or service must be made on site during the activity to the subcontractor of LA CASANITA Ltd, it is the direct responsibility of the subcontractor of LA CASANITA Ltd to make every effort to satisfy its request. If no arrangement between these parties can be found, it is up to them to make their grievances known to LA CASANITA Ltd in writing. We reserve the right to award possible compensation if it turns out after analysis that, clearly, the subcontractor of LA CASANITA Ltd has failed in its obligations. In any event, compensation may never exceed the reimbursement of the price of the service itself. The client has the option of booking the dates they wish to participate in during their stay, or of requesting LA CASANITA Ltd to book the dates prior to their arrival. LA CASANITA Ltd cannot be held responsible for the cancellation of a service by its subcontractor, whether due to adverse weather, force majeure, security reasons, insufficient minimum reservations, or any other reason provided by the subcontractor, which the latter must justify. Where possible, the service will be postponed to a later date. If it is impossible to perform the activity, the price of the activity will be refunded. Any service that has already been started will not be refunded, in whole or in part.

 

Liability, Litigation

No dispute regarding the price of the trip will be considered upon return. It is up to the customer to assess whether the price is acceptable to them before departure. To be taken into account, any observations or shortcomings regarding the trip must be reported to LA CASANITA Ltd by registered letter within 24 hours of the problem, attaching all supporting documents for the damage suffered, so that commercial compensation may be considered. LA CASANITA Ltd is bound by an obligation of means under this Agreement. If LA CASANITA Ltd is found liable for a service ordered pursuant to this Agreement, the maximum amount of damages to which it may be liable is, in any event, capped at the price charged by LA CASANITA Ltd for the service in question. In the event of a dispute or disagreement, it is agreed that, prior to any legal action, the parties will make every effort to resolve their dispute amicably. However, if attempts at amicable reconciliation prove unsuccessful and in the event of disagreement or persistent difficulty regarding the interpretation and execution of this contract, the dispute will be submitted to the Court of Port-Louis - Mauritius, it being specified on this point that the contractual agreements and their possible annexes are entirely subject to the provisions of Mauritian law.
